By downloading, installing, accessing, or using the MAXD mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MAXD ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the App after such modifications constitutes acceptance of the updated Terms.
MAXD is an AI-powered gym and fitness application that provides:
The App is designed for informational and motivational purposes only and does not constitute medical, nutritional, or professional fitness advice.
You must be at least 13 years of age to use the App. If you are under 18 years of age, you must have the consent of a parent or legal guardian to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

MAXD offers both free and premium subscription tiers:
Basic access to the App with limited features, including a limited number of AI scans and basic workout plans.
Premium access unlocks all features including unlimited AI scans, advanced analytics, personalized plans, and exclusive content. Premium is available at the following pricing:
New users may be eligible for a 3-day free trial of the Premium subscription. After the trial period ends, you will be automatically charged the subscription fee for the plan you selected unless you cancel before the trial expires.
All subscription payments are processed through the Apple App Store. Refund requests must be submitted directly to Apple in accordance with their refund policies. MAXD does not process refunds directly.
You agree to use the App in compliance with all applicable laws and regulations. You agree not to:
MAXD includes community features where users can share posts and interact with one another. When participating in the community, you must:
We reserve the right to review, moderate, remove, or restrict any content posted within the community at our sole discretion. Content that violates these guidelines or Terms may be removed without notice. Users who repeatedly violate community guidelines may have their accounts suspended or permanently banned.
Designated moderators may assist in enforcing community guidelines. Moderator decisions regarding content removal or user warnings are considered final.
By submitting, posting, or sharing content through the App (including photos, text, progress updates, and community posts), you:
We do not claim ownership of your personal data, photos submitted for AI analysis, or private profile information. Photos submitted for AI scanning are processed for analysis purposes and handled in accordance with our Privacy Policy.
All intellectual property rights in the App, including but not limited to:
are owned by or licensed to MAXD and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the App without our prior written consent.
The AI-powered analysis features of MAXD (body scanning, meal analysis) are provided for informational and entertainment purposes only. You acknowledge and agree that:
MAXD is not a medical device, healthcare provider, or licensed fitness professional. The App does not provide medical advice, diagnosis, or treatment. Before starting any exercise program, diet, or fitness regimen suggested by the App:
You assume all risks associated with following any workout plans, exercise routines, or nutritional suggestions provided through the App.
The App integrates with third-party services to provide its functionality. These services include but are not limited to:

Upon termination, your right to use the App ceases immediately. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with applicable arbitration rules, unless otherwise required by applicable law.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
